Welcome to Harmony Layers. These terms and conditions outline the rules and regulations for the use of our website and services.

By accessing this website and using our services, we assume you accept these terms and conditions in full. Do not continue to use Harmony Layers' website or services if you do not accept all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement, and any other agreements: "Client," "You," and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company," "Ourselves," "We," "Our," and "Us," refers to Harmony Layers. "Party," "Parties," or "Us," refers to both the Client and ourselves, or either the Client or ourselves.

Use of Website

Unless otherwise stated, Harmony Layers and/or its licensors own the intellectual property rights for all material on this website. All intellectual property rights are reserved. You may view and/or print pages from the website for your own personal use subject to restrictions set in these terms and conditions.

Restrictions

You are specifically restricted from:

  • Publishing any website material in any other media
  • Selling, sublicensing, and/or otherwise commercializing any website material
  • Publicly performing and/or showing any website material
  • Using this website in any way that is or may be damaging to this website
  • Using this website in any way that impacts user access to this website
  • Using this website contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the website, or to any person or business entity
  • Engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to this website

Certain areas of this website are restricted from access by you and Harmony Layers may further restrict access by you to any areas of this website, at any time, in its sole and absolute discretion.

Booking Terms

Making a Booking

When you make a booking with Harmony Layers, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. A contract will exist as soon as we issue our confirmation invoice. This contract is made on the terms of these booking conditions, which are governed by English Law, and the jurisdiction of the English Courts.

Booking Requirements

To secure a booking, the following is required:

  • A completed booking form
  • The applicable deposit or full payment (as specified at the time of booking)
  • All relevant information for each traveler, including passport details where necessary
  • Any special requirements should be communicated at the time of booking

Pricing and Payment

All prices shown are per person and in British Pounds (GBP) unless otherwise specified.

  • A non-refundable deposit (typically 25% of the total tour cost) is required at the time of booking
  • Full payment is due 60 days prior to departure for standard tours, or as specified for custom tours
  • For bookings made within 60 days of departure, full payment is required at the time of booking
  • Payment can be made by credit card, bank transfer, or other methods as specified during the booking process
  • Additional charges may apply for certain payment methods

We reserve the right to alter the prices of any of the travel arrangements shown on our website. You will be advised of the current price of the travel arrangements that you wish to book before your contract is confirmed.

Price Changes After Booking

After booking, we may only increase the price in the following circumstances:

  • Currency exchange rate fluctuations
  • Increase in transportation costs (including fuel)
  • Changes in dues, taxes, or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports or airports
  • Government action that affects the price of your travel arrangements

In any case, we will absorb, and you will not be charged for, any increase equivalent to 2% of the price of your travel arrangements. If the increase is greater than 10% of your holiday price, you will have the option of accepting the change or canceling and receiving a full refund.

Your Responsibilities

Travel Documentation

It is your responsibility to ensure that you have valid documentation for travel, including:

  • A valid passport (with at least six months validity beyond your return date)
  • Any required visas
  • Any necessary vaccination certificates
  • Travel insurance documentation

We cannot accept responsibility if you are refused entry onto a flight or into any country due to failure on your part to carry the correct documentation.

Travel Insurance

It is a condition of booking that you have adequate travel insurance that provides coverage for the activities included in your itinerary, cancellation, medical expenses, and repatriation in the event of accident or illness. We reserve the right to request proof of insurance coverage.

Health and Fitness

It is your responsibility to ensure that you are sufficiently fit and healthy to complete your chosen itinerary. If you have any concerns about your fitness, please consult your doctor before booking. You should advise us of any medical conditions or dietary requirements at the time of booking.

Behavior

We expect all clients to behave with consideration toward other people. If in our reasonable opinion or in the reasonable opinion of any other person in authority, you behave in such a way as to cause or be likely to cause danger, upset, or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the tour of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation or other service. We will have no further responsibility toward such person(s). No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

Our Liability

Limitations of Liability

We will accept responsibility for the arrangements we agree to provide or arrange for you as an "organizer" under the Package Travel and Linked Travel Arrangements Regulations 2018, as set out below and as such, we are responsible for the proper provision of all travel services included in your package, as set out in your confirmation invoice. Subject to these Booking Conditions, if we or our suppliers negligently perform or arrange those services and we don't remedy or resolve your complaint within a reasonable period of time, and this has affected your enjoyment of your package holiday you may be entitled to an appropriate price reduction or compensation or both.

Force Majeure

We will not be liable for any failure to perform our obligations where that failure is as a result of causes beyond our control. Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lockouts, riots, civil unrest, fire, flood, storm, earthquakes, volcanic eruptions, acts of terrorism, war, governmental action, epidemic or pandemic, or other natural disaster or event beyond our reasonable control.

Third-Party Suppliers

We act as an agent for various third-party suppliers such as airlines, hotels, transport companies, and other suppliers. These suppliers are independent businesses and are not our employees or agents. We are not responsible for the actions or omissions of these suppliers.

Excursions

Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your package holiday provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.

Changes and Cancellations

Changes by You

If you wish to change your booking in any way after our confirmation invoice has been issued, we will do our best to accommodate your request, but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking. You will be asked to pay an administration charge of £50 per person, and any further costs we incur in making this alteration. Please note that certain travel arrangements may not be changeable after a reservation has been made and any alteration request could incur a cancellation charge of up to 100% of that part of the arrangements.

Cancellations by You

You, or any member of your party, may cancel your travel arrangements at any time. Written notification from the person who made the booking must be received at our offices. Since we incur costs in canceling your travel arrangements, you will have to pay cancellation charges as follows:

  • More than 60 days before departure: Loss of deposit
  • 59-42 days before departure: 40% of total booking cost
  • 41-28 days before departure: 60% of total booking cost
  • 27-14 days before departure: 80% of total booking cost
  • Less than 14 days before departure: 100% of total booking cost

Please note that different cancellation charges may apply for certain specialist tours or during peak periods. You will be advised of these at the time of booking.

Changes by Us

It is unlikely that we will have to make any changes to your travel arrangements, but we do plan the arrangements many months in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor, and we will advise you of them at the earliest possible date.

If we make a major change to your holiday, we will inform you as soon as reasonably possible if there is time before your departure. Examples of major changes include: a significant change of destination, a change in accommodation to that of a lower official classification or standard for the whole or a significant part of your time away, a change of departure time or overall length of your holiday of twelve or more hours, or the closure of the only or all advertised swimming pool(s) at your accommodation for an extended period.

You will have the choice of either accepting the change of arrangements, accepting an offer of alternative travel arrangements of comparable standard from us if available (we will refund any price difference if the alternative is of a lower value), or canceling your holiday and receiving a full refund of all monies paid. In all cases, except where the major change arises due to reasons of force majeure, we will pay compensation as detailed below:

  • More than 60 days before departure: Nil
  • 59-42 days before departure: £10 per person
  • 41-28 days before departure: £20 per person
  • 27-14 days before departure: £30 per person
  • Less than 14 days before departure: £40 per person

Cancellations by Us

We reserve the right to cancel your tour in any circumstances, but we will not cancel your tour less than 60 days before departure except for reasons of force majeure or failure by you to pay the final balance. If we are unable to provide the booked travel arrangements, you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of comparable standard from us, if available (we will refund any price difference if the alternative is of a lower value).

In the event a refund is paid to you, we will pay compensation as detailed above, except where the cancellation is due to reasons of force majeure.

All content included on this website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Harmony Layers or its content suppliers and protected by international copyright laws.

Complaints

If you have a problem during your holiday, please inform the relevant supplier (e.g., hotel, tour guide) and our local representative immediately who will endeavor to put things right. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to our Customer Services Department at Harmony Layers, Flat 31 Edward Lane, New Kieran, LA12 0HX, United Kingdom, giving your booking reference and all other relevant information. Please keep your letter concise and to the point. It is strongly recommended that you communicate any complaint to the supplier of the services in question as well as to our representative without delay.

If you fail to follow this simple procedure, we will have been deprived of the opportunity to investigate and rectify your complaint whilst you were in resort and this may affect your rights under this contract.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales will have exclusive jurisdiction to resolve any dispute or claim arising from your use of our website or services.

If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.

Changes to These Terms

We reserve the right to modify these terms and conditions at any time. All changes will be effective immediately upon posting to the website. Your continued use of the website following the posting of changes will mean that you accept and agree to the changes. We advise you to check these terms regularly to ensure you are aware of the most recent version.
